ORDER

In the above-referenced matter, a regulatory hearing was scheduled for Monday, February 5, 1996 at 9:30 a.m. at the Administrative Law Judge Division hearing room, Edgar A. Brown Building, 1205 Pendleton Street, Columbia, South Carolina.

ALJD Rule 45 requires the agency to provide a statement, at least ten (10) days before the scheduled hearing date, confirming the need for a hearing pursuant to S.C. Code Ann. § 1-23-110 (Supp. 1994) on the basis that a request was made by twenty-five (25) persons, a governmental subdivision or agency, or an association having not less than twenty-five (25) members. ALJD Rule 45 also requires that certain jurisdictional documents be prefiled at least ten (10) days before the hearing date.

The agency has not advised this tribunal within the prescribed time that a public hearing is necessary pursuant to S.C. Code Ann. § 1-23-110. Further, the agency has not prefiled any documents. This tribunal, therefore, concludes that a hearing is not necessary.

IT IS THEREFORE ORDERED that the hearing scheduled for February 5, 1996 at 9:30 a.m. is hereby canceled.

IT IS FURTHER ORDERED that this matter is hereby dismissed.

AND IT IS SO ORDERED.
