ORDERS:

ORDER OF DISMISSAL

This matter came before me on the request of the Department of Social Services for a public hearing on proposed regulations, Department of Social Services #114-2910, 114-2920, 114-2930, 114-2940 and 114-2950. The Department published the drafting notice of regulations concerning the issuance of Food Stamp Program benefits by electronic benefits transfers in the South Carolina State Register, Volume 18, Issue 7 dated July 22, 1995. Thereafter, the proposed regulations were drafted and the request for a public hearing was made.

By Order dated August 31, 1995, a public hearing on the proposed regulations was scheduled for November 2, 1995 at the Administrative Law Judge Division. The Order and Notice of Hearing along with the proposed regulations were published in the South Carolina State Register, Volume 19, Issue 9 dated September 22, 1995. The notice provided the time and place for a public hearing on the proposed regulations.

No oral or written comments were received by the Department of Social Services. A hearing was conducted on November 2, 1995 at 9:30 a.m. No member of the public appeared. A public hearing was not required because no request was made by twenty-five (25) persons, a governmental subdivision or agency, or an association having not less than twenty-five (25) members pursuant to S.C. Code Ann. § 1-23-110.

For the foregoing reason, it is ORDERED that the Department of Social Services may proceed with the promulgation of the regulations by submitting them to the General Assembly pursuant to procedures required by law. A copy of this Order shall be transmitted with the appropriate documents to the General Assembly.

AND SO IT IS ORDERED.
