ORDERS:
ORDER OF DISMISSAL
In the above-captioned matter, a regulatory hearing on the proposed repeal of the regulation identified above was scheduled
for 10:00 a.m. on Tuesday, October 15, 2002, at the Administrative Law Judge Division in Columbia, South Carolina.
ALJD Rule 45 requires the agency requesting the hearing to provide a statement, at least ten (10) days before the scheduled
hearing date, confirming the need for a hearing pursuant to S.C. Code Ann. § 1-23-110 (Supp. 2001) on the basis that a
request for hearing was made by twenty-five (25) persons, a governmental subdivision or agency, or an association having
not less than twenty-five (25) members.
The Department advised the Administrative Law Judge Division, by letter filed on August 29, 2002, that no comments or
requests for a hearing were submitted to the Department regarding the proposed repeal of the regulation. Therefore, it is
unnecessary to hold a hearing in this matter.
IT IS THEREFORE ORDERED that the hearing on the proposed repeal of Regulation #129-1 scheduled for October 15,
2002, at 10:00 a.m. is hereby CANCELED.
AND IT IS SO ORDERED.
