ORDER OF DISMISSAL

In the above-captioned matter, a regulatory hearing was scheduled for 9:30 a.m. on Monday, April 23,2001, at the Administrative Law Judge Division hearing room, Edgar A. Brown Building, 1205 Pendleton Street, Columbia, South Carolina.

ALJD Rule 45 requires the agency to provide a statement, at least ten (10) days before the scheduled hearing date, confirming the need for a hearing pursuant to S.C. Code Ann. § 1-23-110 (Supp. 2000) on the basis that a request for hearing was made by twenty-five (25) persons, a governmental subdivision or agency, or an association having not less than twenty-five (25) members.

The Department advised the Administrative Law Judge Division, by letter dated April 16 , 2001, that the Department has withdrawn its proposed regulation and returned the matter to the drafting stage pursuant to written comments from consumer advocacy groups and conversations with those groups. Thus, a hearing is unnecessary in this matter.

IT IS THEREFORE ORDERED that the hearing scheduled for April 23 at 9:30 a.m. is hereby canceled.

AND IT IS SO ORDERED.
