ORDER OF DISMISSAL

A hearing on the "need and reasonableness" of the above proposed regulations was scheduled for 11:00 a.m. on March 13, 2000 at the Administrative Law Judge Division, 1205 Pendleton Street, Columbia, South Carolina.



ALJD Rule 45 requires the agency to provide a statement, at least 10 days before the scheduled hearing date, confirming the need for a hearing pursuant to S.C. Code Ann. § 1-23-110 (Supp. 1998) on the basis that a request for a hearing was made by 25 persons, a governmental subdivision or agency, or an association having not less than 25 members.



By letter dated March 2, 2000, Charles N. Black Jr., Assistant General Counsel for the South Carolina Department of Health and Human Services informed the Administrative Law Judge Division that no comments or requests for a hearing were submitted to the Department. Thus, a hearing is unnecessary in this matter.



IT IS THEREFORE ORDERED that the hearing scheduled in this matter is cancelled.



AND IT IS SO ORDERED.
