ORDERS:

FINAL ORDER

This matter came before the Administrative Law Judge Division for a Contested Case Hearing on Tuesday, April 6, 2004. At the call of the case Respondent Sunliner Xpress Lube, Inc.(Xpress), admitted the following on the record:

1.Xpress admits that it violated 23 S.C. Code Ann. Regulation 7-200.4 by “permitting the purchase of beer by a person under the age of twenty-one,” on September 26, 2003 at its location, Texaco Food Mart, 2150 E. Main Street, Duncan, South Carolina.

2.Xpress further admits that this is its second sale to an underage at this location within a three year period.

3.Xpress further agrees that it will pay the $800.00 fine imposed by the Department within ten days of the hearing, April 6, 2004.

I find Xpress admits this violation freely and voluntarily. Further, I find such to be fair and equitable, and accept Xpress’ admissions to the violation and penalty imposed. This court retains continuing jurisdiction to enforce this Order.

As such I find Xpress violated Regulation 7-200.4 on September 26, 2003 by permitting a person under the age of twenty-one purchase beer on its licensed premises. I further find Xpress shall pay a monetary fine in the amount of $800.00, to the Department, no later than ten days from April 6, 2004.

AND IT IS SO ORDERED.
