ORDERS:
CONSENT ORDER DISMISSING APPEAL WITHOUT PREJUDICE TO PURSUE BOND
This matter came before me by way of an appeal filed by Joseph Todd of a consent order
entered by the South Carolina Residential Builders Commission (the "Commission") dated March
4, 1999. Subsequent to filing this appeal, the appellant discovered the Mr. Johnson was in
bankruptcy. Also subsequent to filing this appeal, counsel for the Respondent filed a motion to
dismiss for alleged lack of standing of the Appellant.
After discussing the appeal, counsel for Mr. Todd and the Commission agreed to dismiss the
appeal without prejudice to Mr. Todd's pursuing any applicable bonds of David W. Johnson,
Palmetto Street Discount Homes, and Lonnie Martin.(1)
THEREFORE, with the consent of the Appellant and the Respondent, this appeal is
dismissed without prejudice to Mr. Todd's pursuing any applicable bonds of David W. Johnson,
Palmetto Street Discount Homes, and Lonnie Martin.
