ORDERS:
ORDER OF DISMISSAL
The above-entitled case is pending before the Administrative Law Judge Division. On May
19, 1999, Notice and Motion to Dismiss Appeal was filed by Richard W. Simmons, II, Attorney for
Respondent. Petitioner has failed to maintain contact with either the Respondent's counsel and the
Administrative Law Judge Division. Further, all attempts to correspond with Plaintiff have failed
due to Petitioner's failure to inform Respondent and this Court of a proper mailing address, therefore
causing the United States Postal Service to return all correspondence to Respondent and this Court
marked "Unclaimed". On April 27, 1999, this Court issued its Order Directing Settlement of the
Record on Appeal in an effort to dispose of the record related issues prior to setting a briefing
schedule. Petitioner failed to comply with the Court's Order and has exhibited complete disregard
for this Court's authority and has created a situation whereby this appeal cannot proceed in the
manner set forth in the ALJD Rules of Procedure. Respondent's Motion to Dismiss Appeal is hereby
granted.
Therefore, IT IS ORDERED that the above appeal be and hereby is dismissed with prejudice.
AND IT IS SO ORDERED.
