ORDERS:
ORDER
This matter came before me on March 30, 1999, as a contest of a citation issued pursuant
to South Carolina Code Section 41-10-40(D). Review was sought pursuant to 41-10-80(D).
Jurisdiction is conferred upon the Administrative Law Judge Division by 1-23-600(B). Petitioner
appeared through counsel, Sharon A. Dantzler; Respondent appeared through counsel, Orrin G.
Briggs.
Prior to the hearing, the parties reached an agreement concerning the resolution of this
matter. Mr. Briggs stated on the record that the respondent, reserving its right to contest the
amount of back wages due to Terra Fowler in another forum, withdrew its contest of the citation
and proposed penalty of $75.00 which is at issue here. There remaining no issue to be
determined by the Administrative Law Judge Division, I accept the agreement.
IT IS THEREFORE ORDERED that the citation and the proposed penalty be affirmed.
Payment in the amount of Seventy Five ($75.00) is due and payable to the South Carolina
Department of Labor, Licensing & Regulation on or before 30 days from the date of this order.
AND IT IS SO ORDERED.
