ORDER REINSTATING CASE TO DOCKET

Because of Respondent's failure to timely file its Prehearing Statement, pursuant to Order of this tribunal dated October 9, 1998, the above-referenced case was dismissed. On October 16, 1998, H. Ronald Stanley, Attorney for Respondent filed a Motion to Reinstate this matter. In the motion, Mr. Stanley stated that he failed to timely file a Prehearing Statement due to inadvertence and excusable neglect. Subsequently, this tribunal held a telephone conference call with Mr. Stanley and Sharon A. Dantzler, Attorney for Petitioner. During the conference call, Mr. Stanley explained why the Prehearing Statement was filed late and apologized to this tribunal. Further, Ms. Dantzler indicated that she had no objections to the case being reinstated.

IT IS THEREFORE ORDERED that this case is hereby reinstated to the docket of this tribunal.

IT IS FURTHER NOTED that this matter will be scheduled and heard as expeditiously as possible.

AND IT IS SO ORDERED.
