ORDERS:
ORDER OF DISMISSAL WITHOUT PREJUDICE
The above-captioned contested case regarding the denial of the issuance of a septic tank
permit, was filed with the Administrative Law Judge Division (Division) on August 15, 2003. On
April 5, 2004, Jason Buffkin, attorney for the Petitioner, filed a letter with the Division in which
he asked that this matter be held in abeyance as the Litchfield Homeowners Association was in the
process of considering whether or not to install a sewer line for the lot which is the subject of this
contested case. Counsel for the Respondent consented to this request. Therefore,
IT IS HEREBY ORDERED that this matter is dismissed WITHOUT PREJUDICE
with the Petitioner granted leave to refile this contested case with the Division within thirty (30)
days of the Litchfield Homeowners Association’s decision regarding the installation of a sewer
line for the lot which is the subject of this contested case.
IT IS FURTHER ORDERED that the filing fee should be waived if this contested case
is refiled with the Division.
AND IT IS SO ORDERED.
