ORDERS:
CONSENT ORDER
IT APPEARING that On August 5, 1998, this Court issued an Order vacating the State Board
of Medical Examiners' (Board) Order of Temporary Suspension, issued on July 2, 1998, which had
temporarily suspended the Petitioner's license to practice medicine. The August 5, 1998 Order
reinstated Petitioner's license subject to certain conditions. Subsequently, this Court issued its
Amended Order on August 10, 1998, said order modifying the conditions of reinstatement. The
August 10, 1998 Amended Order commanded the Board to promptly institute disciplinary proceedings
against the Petitioner and required the Board to hold a Disciplinary Panel hearing within forty-five
(45) days form the date of the original Order, August 5, 1998.
IT FURTHER APPEARS that the Parties, by and through their Attorneys, as is evidenced
by the signatures hereon below, have reached an agreed settlement which they desire to be made an
Order of this Court. This agreement provides for the elimination of the forty-five (45) day
requirement for holding the Disciplinary Panel hearing. Further, the parties agree that they will work
together to schedule said hearing for a time which is mutually agreeable.
NOW, THEREFORE, BY AND WITH THE CONSENT OF THE PARTIES, IT IS
HEREBY ORDERED that the provision in this Court's August 10, 1998 Amended Order, which
requires the holding of a Disciplinary Panel hearing within forty-five (45) days from August 5, 1998,
is hereby rescinded. The parties are hereby ordered to work together in the scheduling of a mutually
agreeable date for the conducting of said hearing.
AND IT IS SO ORDERED.
