ORDERS:
ORDER OF DISMISSAL
This matter is currently pending before the South Carolina Administrative Law Judge
Division, and involves the denial of the Petitioner’s request for an on-premises beer and wine permit
and sale and consumption (minibottle) license by the Department of Revenue (Department). This
denial was based on a public protest as to suitability of the location by Mr. James Weyandt, Jr., and
the need for the Department to conduct a final inspection following the construction of the building
to insure that the building meets the restaurant requirements and distance from a church. By letter
received at the Division on March 30, 2004, the aforementioned Protestant withdrew his protest.
Because Mr. Weyandt was the only Protestant, and the Department asked that the Division
make its decision without any further action by the Department, it is hereby ORDERED that this
matter is dismissed with prejudice; and
IT IS FURTHER ORDERED that, subject to satisfactory completion of a final inspection,
the Department of Revenue issue an on-premises beer and wine permit and sale and consumption
license to the Petitioner for the location at 47 Ferry Road, Beaufort, South Carolina.
AND IT IS SO ORDERED.
