ORDER OF DISMISSAL

This matter is before me pursuant to Petitioner's request for a cease and desist filed with the

Administrative Law Judge Division ("Division")on June 8, 2001. Oral arguments were heard on July 11, 2001 at the Division in Columbia, South Carolina.

On June 12, 2001, the Respondent South Carolina Department of Health and Environmental Control, Office of Ocean and Coastal Resource Management ("OCRM") issued its letter directing Respondent Jessica E. B. Evans to cease and desist from conducting any further dock construction at the subject site making the instant request before the Division moot. Therefore, all other issues raised during oral argument or in written submissions by the parties need not be addressed or decided.

IT IS THEREFORE ORDERED that the request for a cease and desist filed by the Petitioner on June 8, 2001 is dismissed without prejudice.

AND IT IS SO ORDERED.
