This case is before the Administrative Law Judge Division pursuant to the Agency Transmittal Form file April 5, 2001. After Pre-Hearing Statements were filed, the case was set for a hearing to be held on August 29, 2001. By letter dated August 21, 2001, counsel for Respondent requested a continuance in anticipation of settlement. Upon good cause shown and with consent of counsel for Petitioner, the undersigned granted the request for a continuance.

By letter dated October 4, 2001, signed by counsel for Petitioner and counsel for Respondent, the parties indicated they reached an agreement and requested the case be dismissed.

IT IS HEREBY ORDERED that this case is dismissed with prejudice.
