ORDER OF DISMISSAL

This matter is before me pursuant to the Motion to Dismiss filed by Respondent South Carolina Department of Social Services (DSS) on January 4, 2001 with the Administratiave Law Judge Division (ALJD).

According to the said motion, DSS mistakenly filed the appeal for the above matter with the ALJD; however, pursuant to S.C. Reg. 114-140 (C), effective July 28, 2000, this matter shall be heard by the Office of Administrative Hearings of DSS.

DSS stated in its motion that it would be responsible for taking any necessary procedures to have this appeal heard by the proper forum.

Based on the understanding that DSS will take appropriate measures to have this matter heard by the Office of Administrative Hearings of DSS, this matter is dismissed.

IT IS SO ORDERED that this matter is dismissed without prejudice.
