CONSENT ORDER

This matter is before the Court pursuant to an appeal by the Petitioners of the DSS action to remove the foster child, Lamar Robinson from their home.

The Petitioners, Woodrow Alvin Davis and Tina Davis, are the foster parents of the minor child, Lamar O. Robinson, date of birth May 16, 1996. The Petitioners were informed on August 21, 1997 by the Lexington County Department of Social Services that the minor child would be removed from their home. The Department of Social Services received written notice of intent to appeal from the Petitioners on August 22, 1997.

A Motion hearing was held on August 29, 1997 and the minor child was removed from the home of the Petitioners by Order dated August 29, 1997 by the Honorable Richard Chewning.

It has come to the attention of this Court that a final hearing is pending in the Family Court regarding the finalisation of the adoption of the minor child. Therefore, pending the outcome of the Family Court hearing, it is agreed by the parties, Kathy Gettys Woods, attorney for Lexington County DSS and James Fletcher Thompson, attorney for the Petitioners, that the appeal of the Administrative Law Judge Division be held in abeyance.

IT IS SO ORDERED.
