ORDERS:
ORDER OF DISMISSAL
In
the above-captioned matter, Appellant South Carolina Department of Motor
Vehicles (Department) appeals the May 17, 2006 Final Order and Decision of the
South Carolina Division of Motor Vehicle Hearings (DMVH), under its docket
number 06-DMVH-01-0894-CC, in which the DMVH Hearing Officer rescinded the
suspension of Respondent Williams Powers’ driver’s license. However, another,
identical appeal regarding that Final Order and Decision has been filed with
this Court by the Department. That initial appeal was filed on June 21, 2006,
given docket number 06-ALJ-21-0578-AP, and assigned to the Honorable Ralph King
Anderson, III, for adjudication. The instant appeal was subsequently filed on
June 28, 2006, and assigned to the undersigned for adjudication. As this
appeal is entirely duplicative of the earlier appeal filed by the Department,
this matter must be dismissed.
IT
IS THEREFORE ORDERED that the above-captioned case is hereby DISMISSED.
AND
IT IS SO ORDERED.
