ORDER OF DISMISSAL

C O N F I D E N T I A L I T Y

Pursuant to S.C. Code Ann. § 12-54-240(A) (Supp. 1996), it is unlawful for any person to disclose information contained in any State tax returns or reports involving income, sales, use, estate, bank, savings and loan, or casual excise taxes (required under Chapters 7, 16 and 36 of Title 12 of the S.C. Code). Accordingly, all facts arising from this contested case matter, as well as the existence of this contested case, must be kept CONFIDENTIAL. Only the Court, parties, counsel of record, and relevant witnesses named by the parties shall be privy to the confidential information. Disclosure of confidential information to any other person constitutes a misdemeanor and contempt, punishable by a fine and/or imprisonment.

The parties have reached settlement and resolution of the above matter. The terms of settlement are set forth in a Consent Order filed with this Court on January 20, 1998.

IT IS THEREFORE ORDERED that the above-captioned case bearing Docket Number

97-ALJ-17-0151-CC is hereby dismissed with prejudice pursuant to the terms of the Consent Order filed with this Court on January 20, 1998, which is incorporated herein by reference.

AND IT IS SO ORDERED.
