ORDERS:
CONSENT ORDER OF SETTLEMENT AND DISMISSAL
The parties to the above-referenced action have informed the court that they have resolved the
issues contained in Petitioner's appeal of the Respondent's assessment of sales tax, penalties, and
interest against the Petitioner whereby:
1. The Respondent agrees to a partial waiver of penalties previously assessed against the
Petitioner in the amount of $7,198.01.
2. The Petitioner admits to liability for unpaid sales tax assessed by the Respondent in the amount
of $21,224.26, interest on that amount through December 9, 1996, of $14,842.40, and penalties
of $15,951.34, for a total liability owed to the Respondent of $52,000.00.
3. The Petitioner further understands that payment of the aforesaid amount shall be made by him
over a period, and within such time as shall be determined by the Respondent's Office Services
Division in accordance with all relevant departmental regulations, procedures, and policies.
Petitioner acknowledges that his failure to make such payments may result in the Respondent's
issuance of a warrant, or such other actions as are deemed necessary to insure payment of the
agreed upon liability.
Having reviewed this agreement and settlement in compromise, and having questioned the parties
regarding the terms thereof, I hereby ORDER that the Petition in this matter be dismissed with
prejudice.
AND IT IS SO ORDERED.
