ORDERS:
ORDER OF REMAND
GRIEVANCE NO. LCI 9107-03
On April 9, 2003, Respondent South Carolina Department of Corrections (DOC or Department)
revoked twenty days of Appellant’s “good-time” credits as punishment for damaging property in
violation of DOC Disciplinary Code § 2.07. Appellant appealed that decision to this tribunal. However,
on January 29, 2004, the Department, upon reviewing the record, determined that Appellant’s
disciplinary conviction should be overturned, and requested that this matter be remanded to the
Department for it to overturn the conviction and restore to Appellant any good-time credits lost and
restitution paid by Appellant as a result of that conviction. Appellant has not filed a response to this
motion.
As the Department has agreed to provide Appellant with the relief he seeks by overturning his
disciplinary conviction, and as Appellant has not objected to the proposed remand,
IT IS THEREFORE ORDERED that this matter is hereby REMANDED to the Department
so that it can overturn Appellant’s April 9, 2003 disciplinary conviction for damaging property, and
restore to Appellant any good-time credits lost and restitution paid by Appellant as a result of that
conviction.
IT IS FURTHER ORDERED that the Department must provide Appellant with this relief
within thirty (30) days of the date of this Order.
