ORDER DENYING MOTION FOR RECONSIDERATION

This matter comes before me upon a Motion For Reconsideration filed by Petitioner Oscar C. Fitzhenry for reconsideration of the final Order issued by this Court in the above matter on November 15, 1996, directing the Charleston County Assessor to value Petitioner's property (PID #93/421-06-00-009) at a value of $75,230 for assessment year 1993. Pursuant to ALJD Rule 29(C), a party may move for reconsideration of a final decision of an administrative law judge in a contested case; however, absent a showing that the Findings of Fact or Conclusions of Law are unsupported by the evidence or are otherwise defective or incomplete, a motion for reconsideration of an order will be refused. 89 C.J.S. Trial § 638 (1955). The issues have been thoroughly litigated and the Order is supported by the relevant evidence and applicable law.

IT IS THEREFORE ORDERED that Petitioner's Motion for Reconsideration is denied, and the Court's Order of November 15, 1996, remains in effect as the final administrative decision and order in this case.

AND IT IS SO ORDERED.
