ORDER OF DISMISSAL

This matter comes before the undersigned Administrative Law Judge pursuant to Charleston County Assessor's' appeal of a decision rendered by the Charleston Board of Assessment Appeals reversing the Assessor's removal of the 4% legal residence ratio from certain property owned by the Respondent. A contested case hearing was scheduled for November 15, 2001. However, on November 15, 2001, prior to the hearing, the Assessor withdrew its appeal. Accordingly,

IT IS THEREFORE ORDERED that this matter is DISMISSED with prejudice.

IT IS FURTHER ORDERED that the decision of the Charleston Board of Assessment Appeals returning the 4% legal residence ratio to the property in question is AFFIRMED.

AND IT IS SO ORDERED.
