CONSENT ORDER

This matter came before the Court from an appeal of the Respondent Sunliner Express Lube, Inc. of a Violation Report issued by the South Carolina Law Enforcement Division ("SLED") and subsequent Final Agency Determination by the Petitioner South Carolina Department of Revenue ("Department") against the Respondent for a violation of South Carolina Code Ann. Section 12-21-2791 on or about March 27, 1998. The citation issued to Respondent on that date was for a violation of that provision of the law limiting payouts from credits earned on Class III video game machines in excess of $125.00. The Department sought a $500 fine from the Respondent for this violation.



A hearing was scheduled in this matter before the Court on July 28, 1998. Prior to the hearing, the Respondent agreed to waive its request for a hearing and agreed to pay the fine of $500 sought by the Department. A check from the Respondent for the amount of the fine was received by the Department on July 27, 1999.



In light of the Respondent's agreement to, and payment of, the fine sought by the Department in this matter, I hereby dismiss the Petition in this matter with prejudice.
