ORDER OF DISMISSAL

In the above-captioned matter, a regulatory hearing was scheduled for 10:00 a.m. on Wednesday, January 15, 2003, at the Administrative Law Judge Division, Edgar A. Brown Building, 1205 Pendleton Street, Columbia, South Carolina.

ALJD Rule 45 requires the agency proposing the regulation to provide a statement, at least ten days before the scheduled hearing date, confirming the need for a hearing pursuant to S.C. Code Ann. § 1-23-110 (Supp. 2002) on the basis that a request for hearing was made by 25 persons, a governmental subdivision or agency, or an association having not less than 25 members. In the instant matter, the South Carolina Department of Revenue advised this tribunal, by letter dated January 3, 2003, that no comments or requests for a hearing were submitted to the Department regarding the proposed regulation. Thus, pursuant to Section 1-23-110(A)(3), it is not necessary to hold a hearing in this matter.

AND IT IS SO ORDERED.
