ORDER GRANTING STAY

The above-captioned matter comes before me upon a Notice of Motion and Motion For Order Staying Decision Of Administrative Law Judge Pending Judicial Review. Respondents request that my Order dated April 13, 1998, be stayed pending appeal pursuant to S.C. Code Ann. § 1-23-380(A)(2)(Supp. 1997). The Order revoked fifteen Class III video game machine licenses at Respondent's establishment at 9585 Highway 78, Ladson, South Carolina for violation of S.C. Code Ann. § 12-21-2804 (A)(Supp. 1996). The Order also fined $5,000.00 against Respondent Michael A. Kocak and prohibited the operation of any Class III video game machines at the location for six (6) months from the date of the revocation of the fifteen licenses.

Upon review of the Motion, it is hereby ORDERED that, upon the timely filing of a Notice of Appeal by the Respondent, the Final Order of April 13, 1998, shall be stayed.

IT IS FURTHER ORDERED that, should the Respondent fail to timely file a Notice of Appeal, the Order of April 13, 1998, shall remain in full force and effect.

AND IT IS SO ORDERED.
