ORDERS:
ORDER STRIKING CASE FROM DOCKET
In a telephone conversation on December 12, 2003, and by a letter dated January 10, 2004,
the parties to the above-captioned case notified this tribunal that they have reached a tentative
settlement of this matter. However, as the proposed settlement depends upon obtaining a modified
wetland permit from the United States Army Corps of Engineers, the parties informed this tribunal
that they cannot immediately finalize their settlement, and therefore, they further request that this
matter be stricken from the active docket of the Administrative Law Judge Division with leave to
reinstate the case, if necessary, pending the results of the modification process.
Therefore, pursuant to the parties’ request and under the guidance of Rule 40(j), SCRCP,
which may be applied, as practicable, to this matter pursuant to ALJD Rule 68,
IT IS HEREBY ORDERED that the above-captioned case is STRICKEN from the active
docket of the Administrative Law Judge Division.
IT IS FURTHER ORDERED that this case may be restored to the active docket of the
Division upon motion of either party, if such motion is made within thirty (30) days of the final
decision of the United States Army Corps of Engineers on the parties’ permit modification request.
However, if no such motion is made within one year of the date of this Order, this case shall not be
reinstated to the active docket of the Division.
AND IT IS SO ORDERED.
