On June 24, 1998, the above-referenced case was filed with the Administrative Law Judge Division. On September 10, 1998, Carol I. McMahan, Attorney for Petitioner, filed a Notice and Motion to Dismiss this matter with prejudice because the whereabouts of a witness essential to the case remain unknown. For the foregoing reason, this action should be dismissed.

IT IS THEREFORE ORDERED that the above entitled case is hereby dismissed with prejudice.
