ORDERS:
CONSENT ORDER
This matter was initiated on November 19, 1997, by the South Carolina Law
Enforcement Division ("SLED"), when its agents conducted an inspection of Respondent's premises
and issued a citation to the licensee for violating the provisions of S.C. Code Ann. 61-4-580(3)
(Supp. 1997) for "permitting gambling or games of chance" on the licensed premises. The South
Carolina Department of Revenue ("Department") issued a Final Department determination imposing
a violation and seeking a forty-five day suspension of Respondent's beer and wine permit as this is
the third such offense in a three year period.
Prior to a hearing on this matter, the parties worked out an agreement. That
agreement is incorporated into this order. The agreement between the parties is:
1. For the violation on November 19, 1997, Respondent agrees to a forty-five day
suspension of its beer and wine permit. This suspension will begin October 12, 1998 and end at
midnight on November 25, 1998. Respondent will surrender the beer and wine permit to the
Department to begin this suspension period.
2. In consideration of the above, the Department agrees to the dismissal of this matter
with prejudice.
I find the above agreement to be fair and equitable, approve such agreement and
hereby order its adoption. The Court retains continuing jurisdiction to enforce this Order.
