ORDERS:
CONSENT ORDER
Agents for the State Law Enforcement Division cited Respondent for the following
violations: December 8, 1996, for selling liquor during restricted hours, April 6, 1997, for
possessing liquor in containers larger than two ounces; April 6, 1997, for permitting unlawful
possession of liquor; April 6, 1997, for selling liquor during restricted hours; and May 30 and
June 22, 1997, for not being primarily and substantially engaged in the preparation and serving
of meals.
Respondent accepts revocation of its sale and consumption license based upon its
violation of S.C. Code Ann. § 61-6-1820(1) (Supp. 1996) by its failure to be primarily and
substantially engaged in the preparation and serving of meals. Respondent consents to the
revocation of its beer and wine permit under the provisions of S.C. Code Ann. § 61-2-14-(E)
(Supp. 1996). Respondent also agrees not to seek a refund of any unused portion of its beer and
wine permit and minibottle license. Respondent neither admits or denies the
other charges cited above.
Based upon Respondent's consent to the revocation of its permit and license, Petitioner
agrees to waive all monetary penalties, and agrees not to proceed on the other charges cited
above.
I find that the agreement of the parties is a satisfactory resolution of the
contested matter between the parties, is fair and reasonable, and hereby order its adoption.
IT IS SO ORDERED.
