This matter comes before the Court on motion of Patrick E. Knie, Attorney for the Respondent, moving the Court for an Order of Dismissal on the basis that the licensee admits the violation. The issue on the imposition of the penalty is moot as Respondent's license is scheduled to expire November 30, 1996 and that the Respondent does not seek the renewal thereof nor plans to seek a new license at the present location at 3059 Howard Street, Spartanburg, South Carolina 29303.

Therefore, for good cause shown and having noted the consent of the South Carolina Department of Revenue, it is hereby

ORDERED that the above-entitled matter be and is hereby dismissed.

IT IS SO ORDERED.
