ORDER OF DISMISSAL

This matter was pending before me on the citation issued by the South Carolina Department of Revenue and Taxation against Jimmy E. Sellers, d/b/a Sellers General Merchandise for a violation of 23 S.C. Code Regs. 7-9(B) (Supp. 1976), sale of beer and wine to a person under the age of twenty-one (21) years of age on or about September 27, 1995. The Department is seeking a monetary penalty of $200 against the off-premises beer and wine permit issued to Jimmy E. Sellers for location at 104 East Main Street, Scranton, South Carolina. After notice was sent to the parties, a hearing was scheduled for Tuesday, September 10, 1996 at 3:00 p.m.

By letter dated and filed with the Administrative Law Judge Division on August 12, 1996 and

received on August 15, 1996 (herein attached as Exhibit A), the Respondent, Jimmy E. Sellers , has withdrawn his request for an administrative hearing on the violation and wishes to pay the incurred fine of $200 imposed by the Department of Revenue and Taxation.

By withdrawing the request, it appears that no further action is required. It is therefore,

ORDERED, that the Respondent shall pay the $200 fine to the Department of Revenue and Taxation within fifteen (15) days of the date of this Order and that the above-referenced case is DISMISSED.
