ORDERS:
ORDER OF DISMISSAL
A letter dated July 3, 1996, was filed with the Court on July 8, 1996, by
James C. Cox, Jr., Attorney for Respondent, advising that the Respondent was "withdrawing his
protest of proposed sanctions" in the above matter. A teleconference was held on July 11, 1996,
with Mr. Cox and Carol I. McMahan, Attorney for Petitioner, wherein the Court determined that
Respondent no longer requests a hearing, admits the violation, and accepts the sanction sought by
DOR.
The South Carolina Department of Revenue and Taxation ("DOR") alleges that on
January 26, 1996, one of Respondent's employees knowingly permitted the purchase of beer by
an underage individual on the licensed premises, in violation of 23 S.C. Code Ann. Regs. 7-9(B)
(Supp. 1995). Accordingly, DOR seeks a forty-five (45) day suspension of Respondent's license
(AI 0028669, BG 727792).
IT IS THEREFORE ORDERED that Respondent's license (AI 0028669, BG 727792)
is hereby suspended for a period of forty-five (45) days. This Order shall be served upon
Respondent by a duly qualified agent of the South Carolina Department of Revenue and Taxation,
and the 45-day period of suspension shall commence the day following the date of service of this
Order upon Respondent.
IT IS FURTHER ORDERED that with the consent of the parties, the above-captioned
case bearing Docket Number 96-ALJ-17-0259-CC is hereby dismissed with prejudice.
AND IT IS SO ORDERED.
