ORDERS:
ORDER OF DISMISSAL
The above-captioned matter was scheduled for a hearing before me on August 7, 1995
pursuant to S.C. Code Ann. § 61-1-55 (Supp. 1994) and S. C. Code Ann. § 1-23-310, et seq.
(Supp. 1994). Petitioner, South Carolina Department of Revenue and Taxation, initiated this
action seeking a thirty (30) day suspension of the beer and wine permit of Rodney R. Wallace,
d/b/a Corner Convenience Store. Petitioner alleged that respondent or his employee permitted the
purchase of beer by a person under 21 years of age on or about April 22, 1995 in violation of 23
S.C. Code Ann. Reg. 7-9(B) (Supp. 1994).
Prior to the hearing, the parties resolved the issue in dispute and entered into a settlement
agreement which was read into the record. Therefore, a hearing on the merits was no longer
necessary.
IT IS THEREFORE ORDERED that this matter is hereby dismissed and the terms of
the settlement agreement entered into the record are hereby incorporated into this Order by
reference.
AND IT IS SO ORDERED.
