ORDER AND DECISION

This matter came before the Administrative Law Judge Division for a hearing on citations issued against Kent G. Ingram. After notice to the parties, a hearing was conducted on March 16, 1995.

At the hearing, the parties stipulated to the following facts: On November 3, 1994, Brandon Strickland, an underage individual cooperating with the Alcohol Enforcement Unit entered the Kent's Korners gas station convenience stores located at Main Street and at West Railroad Avenue for the purpose of purchasing beer. At the time, Strickland was eighteen (18) years old. The clerk requested identification. Strickland presented his drivers license showing his correct age upon request. The beer was still sold to him. This is the second violation of each location. The Respondent offered evidence of the training program implemented after the first violation in mitigation to this offense.

Both locations are charged with violating Reg. 7-9(B) which prohibits a licensed location from permitting or knowingly allowing a person under the age of twenty-one (21) to purchase beer and wine. The evidence supports the violations and citations issued.

Based upon the facts and the applicable law, it is ordered that the Respondent shall pay $750 for each violation within ten (10) days of the date of this Order or the beer and wine permits shall be suspended for twenty (20) days.

AND IT IS SO ORDERED.
