ORDERS:
ORDER OF SETTLEMENT AND DISMISSAL
This matter came before the Administrative Law Judge Division for a hearing on the citation
issued by the Department of Revenue and Taxation against Rene F. Warfield for a violation of
Section 61-5-110 for avoiding taxes by refilling mini-bottles.
After Notice of Hearing, the parties discussed settlement and resolution of the violation.
Based upon the discussion, the parties have agreed to the following:
1. Rene F. Warfield will voluntarily surrender her sale and consumption license and any other license she has for the location called Nay-Nay's Hideaway, 5511 Two Notch Road, Columbia, South Carolina.
2. The Department will reduce the original fine imposed from $1000 to $300 to be paid within six (6) months.
3. Ms. Warfield shall contact the Department within ten (10) days from the date of this order to arrange a payment plan for the fine. The failure to pay the fine according to the schedule agreed upon with the Department may result in additional actions by the Department.
Based upon the foregoing settlement between the parties, it is therefore,
ORDERED, that Rene F. Warfield surrender her license for Nay-Nay's Hideaway located at
5511 Two Notch Road, Columbia, South Carolina to the Department within ten (10) days from the
date of this Order, and a fine of $300 is imposed to be paid within six (6) months pursuant to a
schedule established with the Department.
It is FURTHER ORDERED that this matter is SETTLED and DISMISSED.
