This matter is currently pending before the South Carolina Administrative Law Judge Division. This matter involves a request for a contested case hearing by the Respondent concerning an administrative violation with a forty-five day permit suspension levied by the Department of Revenue. By letter of counsel for Respondent filed with the Division on October 2, 2002, Respondent withdrew his request for a hearing. He also stated that the Petitioner has consented to this withdrawal and will impose the forty-five day permit suspension. Therefore, having no request for a hearing, it is hereby

ORDERED that this matter is dismissed with prejudice.
