ORDERS:
CONSENT ORDER
This matter was initiated by a citation issued by the South Carolina Law Enforcement Division (SLED) against
Respondent, The Rainbow Mission (a corporation)("Rainbow"), for a violation of 23 S.C. Code Ann. Regulation 7-17
(J)(Supp.2001), for "permitting consumption of liquor by a nonmember," for the third time within a three year period. The
South Carolina Department of Revenue (Department) issued its Final Department Determination sustaining this violation
and seeking a fine of $500.00 and revocation of Respondent's private club sales and consumption license. Respondent
appealed this determination and the matter was transmitted to the Administrative Law Judge Division (Division).
Prior to the hearing scheduled on this matter before the Honorable Carolyn C. Matthews, the parties entered into an
agreement resolving the issue. That agreement is incorporated in this Order.
The agreement between the parties is as follows:
1. For the violation on August 17, 2001, Rainbow agrees to surrender its private club
sales and consumption license and beer and wine permit in revocation to the Department at its office at 301 Gervais Street,
Columbia, South Carolina, no later than 5:00 p.m. on May 6, 2002. Rainbow further agrees to remit a check in the amount
of $500.00 to the Department on April 17, 2002.
2. The Department agrees to accept the foregoing in satisfaction of the violation.
3. The parties further agree that this agreement is with prejudice.
I find this agreement to be fair and equitable, approve such agreement, and hereby order its adoption. This court retains
continuing jurisdiction to enforce this Order.
AND IT IS SO ORDERED.
