ORDER OF DISMISSAL

This matter is before the Administrative Law Judge Division pursuant to an Agency Transmittal Form received on October 5, 2001. Respondent requested a contested case hearing regarding the Department's finding of an administrative violation for permitting the purchase of beer by a person under the age of twenty-one for the fourth time in a three year period. By letter dated October 30, 2001, counsel for Respondent indicated Respondent sold the store and relinquished the beer and wine permit and, therefore, wished to withdraw its request for a hearing.

IT IS HEREBY ORDERED that this case is dismissed.

AND IT IS SO ORDERED.
