ORDERS:
CONSENT ORDER
This matter was initiated by a citation issued by the South Carolina Law Enforcement Division (SLED) against the
Respondent, Jennings L. Jackson, d/b/a Jackson's Gulf (Jackson), for a violation of 23 S.C. Code Ann. Regs. 7-86 (Supp.
2000) for "delivery of beer and wine during restricted hours" on April 22, 2001. The South Carolina Department of
Revenue (Department) issued its Final Department Determination sustaining this violation and imposing a forty-five day
suspension of Jackson's beer and wine permit. Jackson appealed the matter and it was transmitted to the Administrative
Law Judge Division (Division).
Prior to the hearing scheduled on this matter, the parties entered into an agreement resolving the issue. That agreement is
incorporated into this Order.
The agreement between the parties is as follows:
1. For the violation on April 22, 2001, Jackson agrees to serve a thirty day suspension of his beer and wine permit. This
suspension will begin on January 8, 2002 and will run continuously for a period of thirty days. Jackson further agrees to
surrender this permit to an agent of SLED to begin service of this suspension.
2. The Department agrees to accept this thirty day suspension in satisfaction of the violation.
3. The parties further agree that this agreement is with prejudice.
I find this agreement to be fair and equitable, approve such agreement, and hereby Order its adoption. This court retains
jurisdiction to enforce this Order.
AND IT IS SO ORDERED.
