ORDERS:
CONSENT ORDER OF DISMISSAL
This matter is before the Court based on the issuance of an Administrative Violation and the South
Carolina Department of Revenue's ("Department") Final Determination to Respondent The Horn, Inc.,
d/b/a Straight Shooters citing violation of 23 S.C. Code Ann. Regs. 7-9(B) and 7-17(J) which occurred
on or about September 1, 2000. Respondent appealed the Department's Final Determination seeking
review of the violations charged and the penalties imposed. It appears the Department and the
Respondent have resolved all issues in this case without the necessity of a hearing. Their resolution is
incorporated into this Order as follows:
1. The Respondent acknowledges the violations cited and consents to the revocation of its beer and
wine permit (#32003494PBW) and the revocation of its liquor license (#32002494PSC).
2. The Petitioner acknowledges that the Respondent has voluntarily surrendered both the permit and
the license listed in paragraph one above.
3. The parties further agree that as it pertains to the above-captioned case, this constitutes a full and
final resolution of this matter between the Respondent and the Department with the Department
waiving any monetary penalties as may have applied.
4. Accordingly, the Respondent has withdrawn its request for a contested case hearing.
I find the agreement between the Department and Respondent to be fair and equitable, approve the
agreement, and hereby Order its adoption. The Court retains continuing jurisdiction to enforce the
terms of this Order. Therefore, in consideration of the foregoing, this case is dismissed with prejudice.
AND IT IS SO ORDERED.
