CONSENT ORDER

This matter was initiated by the South Carolina Department of Revenue (Department's) issuance of a Final Department Determination finding Respondent, United Oil Marketers of South Carolina, Inc., d/b/a United Oil 154 (United), violated 23 S.C. Code Ann. Regulation 7-9B (Supp. 2000), by permitting the purchase of beer by a person under the age of twenty-one. United appealed the matter and it was transmitted to the Administrative Law Judge Division (Division) for a hearing. Prior to the hearing the parties resolved the matter. All parties agree that this offense constitutes a first offense against the beer and wine permit. For this offense the parties have agreed that United will pay a fine in the amount of $400.00. Such fine will be paid to the Department no later than 5:00 p.m. on August 31, 2001.



I find this resolution to be fair and equitable to all parties. This Division retains continuing jurisdiction to enforce this Decision. As such, this matter is settled WITH PREJUDICE.



IT IS SO ORDERED.
