CONSENT ORDER

This matter was initiated by the South Carolina Department of Revenue (Department's) issuance of a Final Department Determination finding Respondent, United Oil Marketers, Inc., doing business at 2446 Charleston Highway, Cayce, South Carolina (Lexington County) had violated 23 S.C. Code Ann. Regulation 7-9B, by permitting the purchase of beer by a person under the age of twenty-one. United appealed the matter and it was transmitted for a hearing at the Administrative Law Judge Division. Prior to the hearing, the parties resolved the matter. All parties agree that this offense constitutes a first offense against the beer and wine permit. For this offense the parties have agreed that United will pay a fine in the amount of $400.00. Such fine will be paid to the Department no later than 5:00 p.m. on March1, 2001.



I find this resolution to be fair and equitable to all parties. This Division retains continuing jurisdiction to enforce this Decision. As such, this matter is settled WITH PREJUDICE.
