ORDERS:
CONSENT ORDER
This matter was initiated by a citation issued by the South Carolina Law Enforcement Division (SLED) against Respondent, Mark
Jewett, BG 133575, for a violation of 23 S.C. Code Ann. Regulation 7-9(B) (Supp. 1999), for "permitting purchase of beer by an
individual under the age of twenty-one," on October 19, 1999. The South Carolina Department of Revenue (Department) issued its
Final Department Determination sustaining this violation and imposing a forty-five day suspension of Mr. Jewett's beer and wine
permit. He appealed the matter and it was transmitted to the Administrative Law Judge Division (Division).
Prior to the hearing on this matter, the parties entered into an agreement resolving the matter. That agreement is incorporated in this
Order.
The agreement between the parties is as follows:
1. For the violation on October 19, 1999, Respondent agrees to surrender his beer and wine permit to the Department for service of a
forty-five day suspension. He will surrender the permit to begin the service of suspension, July 28, 2000.
2. The Department accepts the above terms in satisfaction of the violation.
I find this agreement to be fair and equitable, approve such agreement, and hereby Order its adoption. The court retains continuing
jurisdiction to enforce this Order. As Respondent no longer requires a hearing on this matter, I also Order this matter Dismissed with
Prejudice.
AND IT IS SO ORDERED.
