ORDERS:
CONSENT ORDER
On October 21, 1999, Michael Patrick Thompson was working as an underage cooperating individual with the S.C. State Law
Enforcement Division. Mr. Thompson was born on April 18, 1980, and was 19 years of age on October 21, 1999. On October 21,
1999, Mr. Thompson entered the Piggly Wiggly at 1700 N. Kings Highway, Myrtle Beach, S.C., and was sold a six pack of Busch
Light Beer by an employee of the Piggly Wiggly. Prior to the sale, the employee checked the identification of Mr. Thompson.
Respondent was cited for a violation of 23 S.C. Code Ann. Regs. 7-9(B) (Supp.1999) for permitting the purchase of beer by a person
under 21 years of age.
Respondent consents to a 145 days suspension of its beer and wine permit. Respondent further agrees that this 145 days suspension
will take place beginning one minute after midnight on November 1, 2000. The suspension will end one minute after midnight on
March 25, 2001. Respondent will surrender its beer and wine permit to its attorney on the morning of November 1, 2000.
Respondents attorney will promptly mail that permit to Petitioner. Respondent also agrees to pay a $2,500.00 fine, and to implement
a reasonable set of safeguards and additional training programs to help prevent any future violations. Respondent will submit its
corrective action plan to
the Petitioner prior to January 1, 2001.
I find that the agreement of the parties is a satisfactory resolution of this contested matter, is fair and reasonable, and hereby order its
adoption.
