ORDERS:
CONSENT ORDER
On September 9, 1999, agents for the South Carolina Law Enforcement Division observed that the business located at 62
New Orleans Road, Hilton Head, South Carolina, was not primarily and substantially engaged in the serving and
preparation of meals as required by Regulation 7-19, and S.C. Code Ann. § 61-6-1820 (Supp. 1999) in order for it to hold
a minibottle license. The agents issued an administrative citation against Kings and Aces, Inc., for failing to comply with
Regulation 7-19. The South Carolina Department of Revenue informed Kings and Aces, Inc., that it intended to revoke its
minibottle license for this violation. Kings and Aces, Inc., contested the violation, and a contested case hearing was
scheduled to be held on April 20, 2000.
Kings and Aces, Inc., now wishes to surrender its minibottle license in order to resolve this contested matter. Kings and
Aces, Inc., agrees to surrender its minibottle license to the Department at the conclusion of business on April 28, 2000.
Kings and Aces, Inc., further agrees that it is not entitled to any type of refund for this surrendered license, and that if it
does not surrender the license as stated, the minibottle license is revoked effective April 29, 2000.
I find that the agreement of the parties is a satisfactory resolution of the contested matter between the parties, is fair and
reasonable, and hereby order its adoption.
AND IT IS SO ORDERED.
