ORDER OF DISMISSAL

This matter is before the South Carolina Administrative Law Judge Division ("Division") for a contested case hearing upon the request of Maria S. Martinez, d/b/a Mexico de Noche, 637 W. Broadway St., Myrtle Beach, South Carolina ("Petitioner"). Petitioner filed a renewal application with the South Carolina Department of Revenue ("Respondent") for an on-premise beer and wine permit and sale and consumption (minibottle) license. The application was forwarded to the Division for contested case hearing, citing a Protestant's challenge of Petitioner's U.S. residency status, and further failure by Petitioner to show maintenance of a principal place of business in South Carolina. The merit hearing was scheduled for Tuesday, March 21, 2000, at 1:00 p.m. at the Division. In a letter dated February 28, 2000, counsel for Petitioner notified the Division of Petitioner's desire to withdraw the application for renewal. The letter is attached hereto and incorporated as Exhibit A. By virtue of Petitioner's request for withdrawal of said application, there appears to be no further controversy for consideration.

IT IS THEREFORE ORDERED that the hearing previously scheduled as outlined above, is hereby CANCELED.

IT IS FURTHER ORDERED that the above-captioned case matter is hereby DISMISSED.

AND IT IS SO ORDERED.
