ORDERS:

CONSENT ORDER

This matter is before me by consent of the parties for entry of a Consent Order. The contested cases arise out of a permit, which was issued by Respondent, South Carolina Department of Health and Environmental Control, Office of Ocean and Coastal Resource Management (OCRM), to the Petitioner, Douglas Laird. The Petitioner originally requested a 4' by 70' walkway, leading to a 16' by 16' fixed pierhead. A 5' by 80' timer bulkhead was also proposed and approved. The permit reduced the walkway to 4' by 1' and reduced the size of the fixed pierhead to 10' by 5'. The Petitioner requested a contested case hearing before the Division. No party has moved to intervene.


The parties having resolved their differences, they hereby agree to the following:

1.Permit number OCRM-03-149-R is amended to allow for the construction of a dock, not to exceed 100' in total length, including the fixed pierhead.

2.The size of the fixed pierhead shall be 10' by 12'.

3.The permit is also amended to allow for the installation of a davit system for mooring a boat, with a boat tray.

4.All of the remaining special conditions shall remain in full force and effect.

5.The parties agree that this order is binding on the parties heirs and assigns.


THEREFORE, IT IS ORDERED that permit number OCRM-03-149-R is hereby amended as set forth above and that this case is dismissed with prejudice.


AND IT IS SO ORDERED.
