ORDERS:
ORDER
This matter came before me pursuant to Bob Nelson's protest of the Petitioner's on-premise beer and wine permit. After a
hearing on May 11, 1999, I issued a final decision granting the Petitioner the permit with restrictions.
During the hearing, the petitioner stipulated that he would not permit any performances by live bands at this location and
would operate between the hours of 9:00 p.m. and 2:00 a.m. on Fridays, Saturdays and Sundays. After the decision was
issued in this matter, the Petitioner made a Motion for Reconsideration requesting to amend those stipulations. A conference
call was held on September 29, 1999, in which both the Petitioner's and Protestant's attorney participated. I find that the
amendment of those stipulations is acceptable.
IT IS THEREFORE ORDERED that the final decision dated May 4, 1999, is amended as follows:
1. Petitioner shall be allowed to have live bands at the location provided the music emanating from the band will not be heard
at the residence of the Protestant; and
2. The Petitioner shall be allowed to serve beer and wine on premise at the location, pursuant to the issuance of this permit,
only on Monday, Friday, Saturday and Sunday between the hours of 9:00 p.m. and 2:00 a.m.
AND IT IS ORDERED.
