ORDER OF DISMISSAL BY SETTLEMENT

The above entitled case is pending before the Administrative Law Judge Division. It now appears this case has been fully and finally settled by agreement between the parties and the protestant. Pursuant to a letter dated December 3, 1998, Petitioner's attorney, James H. Harrison, enclosed a letter of withdrawal of the protestant's objection. No objection now being presented, the Respondent has stated that but for the objection it would have granted Petitioner's application for an off-premises beer and wine permit. Therefore, no further controversy exists between the parties.

IT IS HEREBY ORDERED that the above-captioned case be and hereby is settled and dismissed.

AND IT IS SO ORDERED.
